No private organization is capable of issuing such a certification. Any document issued by Accessi that records a state of conformance is an expression of professional assessment, not a certification, accreditation, warranty, or guarantee.
6. Point-in-Time Assessment
Every assessment, audit, test, report, recording, and statement produced by Accessi reflects the state of the Digital Property as observed:
- On the date or dates on which the assessment was carried out.
- In the environments, browsers, operating systems, devices, and assistive technology configurations specified in the applicable engagement documentation.
- Against the accessibility standard and conformance level specified in the applicable engagement documentation.
- Within the scope of pages, screens, user journeys, templates, or components specified in the applicable engagement documentation.
An assessment does not describe the state of the Digital Property at any other time. It is superseded by any subsequent change to the Digital Property, including content publication, code deployment, design change, platform migration, plugin or component update, third-party service change, or configuration change.
Accessibility is an ongoing operational responsibility, not a one-time outcome. Accessi does not monitor a Digital Property after an engagement concludes and has no obligation to notify you of any change in its accessibility, in any applicable standard, or in any applicable law.
7. Limitations of Accessibility Testing
You acknowledge the following inherent limitations of accessibility testing, which apply to all testing methodologies, including those used by Accessi and by every other provider in the industry.
- No testing methodology, and no combination of automated and manual testing, can identify every accessibility defect present in a Digital Property. The absence of a finding is not evidence that no defect exists.
- Automated testing tools detect only a limited proportion of accessibility defects, and are prone to both false positives and false negatives. Automated results are always interpreted by a human assessor, but interpretation remains a matter of professional judgment.
- Manual testing and usability testing are ordinarily conducted on a sample of pages, screens, templates, components, or user journeys. Findings from a sample are indicative of the wider Digital Property but do not constitute a finding in respect of every page or screen.

- Testing is conducted on the platforms specified in the applicable engagement documentation. Unless otherwise stated, testing is conducted on Windows, iOS, and Android devices. Behaviour on untested operating systems, browsers, browser versions, assistive technologies, assistive technology versions, device models, or configurations is not assessed and cannot be inferred.
- Assistive technology behaviour varies between vendors, versions, and user configurations, and changes as vendors release updates. A behaviour observed during testing may differ for another user or at another time.
- Accessibility standards contain success criteria that require subjective judgment. Qualified practitioners may reasonably reach different conclusions on the same interface.
- Dynamic content, content generated by users, content behind authentication that was not made available, content served by third parties, and content published after the assessment date are not covered unless expressly included in the engagement documentation.
- Non-web documents, including files in portable document format, word processing formats, spreadsheet formats, and presentation formats, and media requiring captions, transcripts, or audio description, are not covered unless expressly included in the engagement documentation.
8. No Guarantee Against Complaints or Litigation
Accessi does not warrant, represent, or guarantee that you will not receive a demand letter, complaint, administrative charge, regulatory enquiry, or lawsuit alleging digital inaccessibility, whether before, during, or after an engagement.
Accessi does not warrant, represent, or guarantee that any such matter will be resolved in your favour, or that you will not incur any fine, penalty, damages award, settlement amount, or legal cost.
Claims alleging digital inaccessibility may be brought against an organization irrespective of the measures it has taken, irrespective of the conformance level its Digital Property has achieved, and irrespective of any assessment or documentation obtained from any provider. The outcome of any such matter depends on the facts, the applicable law, the forum, the conduct of the parties, and the judgment of the decision maker, all of which are outside Accessi’s control.
Where any statement published on the Website, made in marketing material, made in correspondence, or made orally by any person appears to promise, guarantee, or imply protection from claims, fines, or litigation, that statement is general promotional language, is not a warranty or representation, and is superseded in full by this Section and by the Terms of Service. Accessibility assessment involves the application of professional judgment to technical standards written in general terms. Findings, severity classifications, and remediation recommendations represent the professional opinion of the assessor at the time of assessment.
Another qualified practitioner, an opposing expert, a regulator, or a court may reach a different conclusion on the same interface. A difference of professional opinion is not evidence of error or negligence.
Remediation recommendations describe an approach considered by Accessi to be technically sound. They are not the only possible approach. Implementation decisions, including the selection of technique, the sequencing of work, and the treatment of competing design or performance considerations, are yours. Accessi is not responsible for the technical implementation of any recommendation, for any defect introduced during implementation, or for any effect of implementation on the functionality, performance, security, or appearance of a Digital Property.
10. Scope of Expertise
Accessi provides digital accessibility services only. Nothing provided by Accessi constitutes, and you must not rely on anything provided by Accessi as:

11. Third-Party Components, Products, and Tools
A Digital Property commonly incorporates components, plugins, widgets, themes, embedded content, fonts, media players, payment interfaces, chat tools, mapping services, analytics tools, and platforms supplied by third parties. Accessibility defects in such components are frequently outside the direct control of the Digital Property owner and outside Accessi’s ability to remediate.
